This document is the complete, formal and current text. The main text and each schedule are integral parts of this document. If they address the same matter inconsistently, the more specific schedule controls, but no provision limits a non-waivable statutory right.
Main Terms
This Refund Policy describes the terms under which HOMI TECHNOLOGY LTD. ("Homi", "we", "us", or "our") provides refunds for products purchased through the Homi platform. This policy is part of our Terms of Service and applies to all orders.
1. Order Cancellation
Orders may be cancelled without charge before the daily order cut-off time. The cut-off time is displayed in the Homi app and varies by Pickup Point.
Cancellation requests after the cut-off time are processed at Homi's discretion. Once an order has been packed or dispatched, cancellation may not be possible.
To cancel, use the "Cancel Order" function in the Homi app or contact us at support@homismart.ca.
Refunds for cancelled orders are processed within 14 calendar days to the original payment method.
2. Problems reported after pickup
Please report a problem promptly, ordinarily within 24 hours after pickup. You may request a refund for an item that is damaged, defective, spoiled, expired, missing, materially different from the order or below reasonable quality expectations. Supply the evidence reasonably available to you, such as a photo, order reference or description. Homi considers the facts and any applicable legal remedy.
The 24-hour period is the standard reporting window for prompt investigation, especially for perishables. It does not remove a remedy for a hidden defect, food-safety issue, recall, unauthorized payment, misrepresentation or other non-waivable right. If the app no longer accepts a request, contact support@homismart.ca.
3. Limits on discretionary refunds
A change of mind, a minor cosmetic variation that does not affect reasonable quality, or a customer's failure to collect within the confirmed window will not ordinarily qualify for a discretionary refund. All exceptions required by law remain available.
Homi or the pickup operator being closed, absent, unable to hand over the order or responsible for unsafe storage is not the customer's failure to collect. A late report is assessed under section 2, not automatically rejected solely for being later than 24 hours.
4. How to request a refund
Open the order in the Homi app, choose the refund option, identify the affected items and reason, and provide available supporting evidence. If the app cannot accept the request or you need help, email support@homismart.ca with the order reference and a description. Avoid sending SINs, tax records or unnecessary identity documents.
A photo may be requested where useful, but inability to provide a photo does not automatically defeat a legally valid claim. Keep the product and packaging where safe and reasonable until Homi gives instructions. Do not consume a product suspected to be unsafe.
5. Review Process
All refund requests are reviewed within 48 hours of submission.
We may contact you for additional information or clarification.
Approved refunds are processed within 14 calendar days.
If a refund request is denied, we will provide the reason for denial.
6. Refund Methods
Refunds are issued to the original payment method used for the purchase.
For credit/debit card payments: refunds typically appear on your statement within 5–10 business days after processing, depending on your financial institution.
We do not issue cash refunds at Pickup Points.
7. Partial and full refunds
If only some items qualify, the refund covers those items. If the whole order qualifies, the full refund includes applicable taxes on the refunded items. Delivery or service fees, if any, are refunded for a full order refund or where the issue is attributable to Homi, including its pickup-fulfilment arrangements, and whenever law requires. A pickup operator's commission, referral reward or unpaid balance is not deducted from the customer's lawful refund.
8. Review of suspected abuse
Homi may investigate specific evidence of refund abuse and take proportionate action under the Terms of Service. A high number of requests alone does not invalidate a claim. Each request is considered on its facts, and Homi will not retaliate against a good-faith complaint or lawful dispute.
9. Statutory Rights
Nothing in this policy limits any statutory rights, warranties, or remedies you may have under applicable Canadian consumer protection legislation, including:
The Consumer Protection Act (Quebec);
The Consumer Protection Act (Ontario);
The Sale of Goods Act (applicable provinces);
The Competition Act (Canada);
Any other applicable federal or provincial consumer protection law.
10. Pickup-point failures and responsibilities
This policy applies equally to Homi-operated facilities and pickup points operated by individuals, sole proprietors, companies, churches, community centres or other organizations, at business or residential premises. An operator's legal status, venue type or tax status does not reduce consumer rights.
The confirmed order date and pickup arrangements govern an existing order. Operators may set their weekly and date-specific availability only within the booking safeguards: they cannot change an affected day's arrangements while unfinished orders exist, including unexpired orders awaiting payment and orders awaiting pickup. If an emergency prevents service, the operator must notify Homi immediately. Homi coordinates a reasonable alternative with the customer where possible or the applicable refund; a customer is not required to agree to an unsuitable replacement location.
Confirmed pickup addresses and phone numbers are changed through Homi, not independently in the operator's profile. An incorrect contact detail, schedule error, pending tax profile, Stripe restriction, closed premises or a disagreement between Homi and the operator is not a reason to defer a legally required customer refund. An operator cannot settle a platform refund in cash, require the customer to waive rights or ask the customer to cover a referral reversal.
Homi records the customer remedy separately from any evidence-based allocation of responsibility, commission adjustment or lawful recovery from an operator under the Pickup Point Agreement. A fault determination is subject to notice and review and does not automatically make an operator responsible for another party's fault.
11. Records, applicable version and contact
Homi retains the order, applicable policy version, request, evidence and decision as reasonably required for fulfilment, accounting, legal duties and disputes under the Privacy Policy. An amended policy does not retroactively remove a customer's accrued rights. You may ask for the applicable policy and decision record, subject to lawful restrictions.

Schedule A: Referral Program and Statutory Refund Protections
A.1 Referral participation does not reduce refund rights
Whether a customer used a referral code, or whether a referrer expects or has received a reward, does not change return, refund, chargeback or consumer-protection rights. Customer-support and refund reviewers must decide only under the order facts, current refund policy and applicable law, and must not deny, delay or reduce a valid refund to protect a referral reward.
A.2 Effect of a refund on the referral reward
A refund, cancellation or chargeback may separately affect the referrer’s reward:
1. A full refund, cancellation, unauthorized payment or chargeback may cancel an unpaid reward or recover a paid reward;
2. A partial refund may cancel or recover the reward if the remaining qualifying amount falls below the threshold saved when the customer bound the referral;
3. If the remaining amount still meets that threshold and no other risk exists, the reward must normally remain valid;
4. A reward hold, cancellation or recovery is not deducted from the customer’s refund and creates no additional customer fee.
Refund and reward outcomes must be logged separately. A referrer disputing a reward decision must use the program’s human-review process and must not contact or pressure the customer.
A.3 Standard 24-hour post-pickup reporting window
The 24-hour period after pickup is the standard reporting window that helps verify perishables, shortages, wrong items and apparent damage. It is not an absolute limitation that removes remedies for a latent defect, food safety issue, recall, unauthorized payment, misrepresentation or a non-waivable consumer right. Homi may reasonably investigate evidence that becomes less reliable over time but cannot deny a legally required remedy solely because the in-App window ended.
An unusually high refund rate may trigger investigation or added verification, but request volume alone does not automatically defeat each valid claim and cannot justify retaliation for a good-faith complaint.
A.4 Product warranties and liability limits
“As-is” terms, allergen notices, liability caps, indemnities and force-majeure clauses apply only to the extent permitted by law. They do not exclude statutory quality, safety, title or description warranties, Homi’s own negligence, fraud, wilful misconduct, personal injury or another liability that cannot legally be excluded. A consumer indemnity is limited to reasonably foreseeable and properly proven loss directly caused by that consumer’s unlawful or wrongful conduct.
A.5 Accessible, retainable and consistent versions
This document is available in English, French and Chinese. No language term limits a mandatory language right under applicable law. For a contract of adhesion and related documents governed by section 55 of Québec’s Charter of the French Language, Homi will first provide the French version. A party may expressly choose another language only after receiving the French version and through a process permitted by law. If the French and another-language versions differ, the party may rely on the version more favourable to that party to the extent permitted by law.
Customers and pickup points must be able to obtain the complete terms before contracting in a mobile-readable, screen-reader-accessible, downloadable or printable form. The material rules, amounts, dates and links must be consistent across English, French and Chinese for the same version. A translation that has not passed review must not be labelled as the formally published version.
A.6 Effectiveness, notice and transition
New customers or applicants may accept this version from the stated effective date. For an existing relationship, a material amendment subject to the 30-day notice commitment takes effect no earlier than 30 days after the required notice is actually given, with fresh affirmative consent where required; a necessary urgent legal or security exception remains limited to its lawful scope. Publishing this version does not prove that an existing user received notice or accepted it. Homi supplies the complete text, version and date in a retainable form. No change rewrites an earlier order, earned reward or missing acceptance record. Participation in new referrals requires the applicable referral terms, while previously earned, undisputed rewards are not forfeited solely for refusing a new version.
